BYLAWS
of the
LEEWARD CHAPTER
ARTICLE I. NAME
The name of
this organization shall be HAWAII STATE TEACHERS ASSOCIATION LEEWARD CHAPTER,
also known as HSTA-Leeward Chapter, which has been chartered by the HSTA-NEA
under the corporation Bylaws.
ARTICLE II. PURPOSE
The purpose
of HSTA Leeward Chapter shall be to carry out goals and objectives as set forth
by the Hawaii State Teachers Association and the NEA; to give all teacher
members a voice in the solution of their educational and professional problems;
to advance the best American ideals and standards of education; to facilitate
academic excellence; to foster cooperation between schools and the community; to
promote friendly relations among members; to encourage members in the discharge
of their professional, community, and civic responsibilities; and to promote the
general welfare of the children in the Leeward District.
ARTICLE III. MEMBERSHIP
Section 1.
Classification or Eligibility.
a.
Active
Membership. Any teacher actively
engaged in education service of a professional nature in the Leeward District is
eligible to become an active member of HSTA Leeward Chapter if that teacher (a)
has earned a bachelors or higher degree; or (b) where required, holds or is
eligible to hold a legal teaching certificate; and (c) pays his or her annual
unified dues to the Hawaii State Teachers Association and the National Education
Association.
b.
Associate Membership. (1)
Any person interested in advancing the cause of
education but who is not eligible for active membership may become an
associate member upon payment of the membership dues.
This shall include staff of HSTA. (2)
Associate members of this organization must be members in good standing
of this Chapter, the Hawaii State Teachers Association and the National
Education Association.

c.
Retired Membership. Any
person retired from a position in the public school system or a private school
system, who has held active membership in the Corporation for at least one year
prior to retirement, shall be eligible to be a retired member.
A person, otherwise eligible, who retired without the requisite year of
active membership, may become eligible by paying full active membership dues for
the deficient number of months after retirement.
The dues for retired members shall be set by the Board.
Section 2.
Privileges of Membership.
a.
Any member of this organization shall be eligible to participate in any
deliberation of this organization, serve on committees, as faculty
representative and as convention delegate; have a vote and shall have the right
to hold office, provided that such a member is not an officer of a competing
organization enrolling teacher members.
b.
Any active member who is temporarily assigned as an Educational Officer
or Educational Specialist shall not be eligible to vote, hold office, or
otherwise participate in the governance of the Chapter during the period of such
assignment.
Section 3.
Membership Year.
The
membership year shall be from September 1 to August 31.
ARTICLE IV. NON-MEMBERS
Any person
who is employed or retired from the public school system as a teacher or other
personnel of the State Department of Education under the same salary schedule
and who is not an active or retired member of the Corporation shall be eligible
to participate in such programs as established by the Board.
ARTICLE V. ORGANIZATION
Section 1.
Composition.
The HSTA
Leeward Chapter shall be vested in two bodies: The Chapter Executive Board and
the Representative Assembly.
Section 2.
Executive Board.
The
Executive Board shall consist of the President, Vice President, Immediate Past
President, Secretary, Treasurer, State Standing Committee Chairperson, Chapter
Committee Chairpersons of the HSTA Leeward Chapter, HSTA Board of
Director(s) and the UniServ
Representative, if assigned.
The
President shall notify the Executive Board members as to the place of said
meeting. The Board shall meet at least once a month.

Section 3.
Representative Assembly.
a.
The Representative Assembly shall include the elected members of the HSTA
Board of Director(s) Chapter Committee Chairpersons, Chapter Officers and
Faculty Representatives. Chapter
Committee Chairpersons, State Standing Committee Chairpersons, and appointed
Faculty Representatives shall be nonvoting members of the Representative
Assembly.
b.
Faculty Representatives shall be elected from each school, district
office, or other unit, by members therein, on a ratio of one representative for
every 10 members, or any major fraction thereof.
c.
Each school, district office or other unit shall be guaranteed at least
one Faculty Representative.
d.
If there is no representative elected 30 days after the start of the
school year, or if the faculty representative is to be replaced, the
chapter president shall be responsible for conducting an election within 30 days
thereafter. If a faculty
representative is unable to complete his/her term of office, the chapter
president may declare the seat vacant and call for a faculty election to fill
the vacancy seat.
e.
The Representative Assembly shall nominate convention delegates as
provided for in the HSTA Bylaws.
f.
The Representative Assembly shall meet at least once a month during the
school year to discuss common concerns and give recommendations for action to
its Director(s) and Executive Board.
Section 4.
Appointments.
a.
The HSTA Leeward Chapter President shall appoint, with the approval of
the HSTA Leeward Chapter Executive Board, Chapter Committee Chairperson(s).
b.
The HSTA Leeward Chapter shall have, but not be limited to, the following
Standing Committees established: Legislative and Political Action; Charter,
Bylaws and Resolutions; Negotiations; Youth, Human and Civil Rights; Elections,
and Membership Services.
Section 5.
Duties.
a.
The Faculty Representative shall:
(1)
Attend all Representative Assembly meetings.
In the event a Faculty Representative cannot attend a meeting, an
alternate shall attend;
(2)
Transmit the concerns of the faculty to the Representative
Assembly and inform the faculty of the actions of the Representative Assembly

(3)
Be eligible to be a delegate to the HSTA Convention
(4)
Communicate the policies and objectives of the HSTA, NEA and the HSTA
Leeward Chapter;
(5)
Be a member in good standing of the HSTA Leeward Chapter, HSTA and NEA;
and
(6)
Participate in all other duties as assigned.
b.
Legislative and Political Action Committee Chairpersons.
The HSTA Leeward
Chapter Chairpersons shall be members of the HSTA Legislative Committee and the
HSTA-PAC and shall carry out the programs as set forth by the HSTA Legislative
Committee and the HSTA-PAC. They
shall also actively work to mobilize members in order to meet the goals set by
the HSTA Legislative Committee and the HSTA-PAC.
c.
Charter, Bylaws and Resolutions Committee Chairperson.
The HSTA Leeward Chapter Chairperson shall be a member of the HSTA
Charter, Bylaws and Resolutions Committee and shall carry out the functions set
forth in the HSTA Bylaws, Article XIII, Section 1 g.
d.
Negotiations Committee Chairperson. The
HSTA Leeward Chapter Chairperson shall be a member of the HSTA Negotiations
Committee and carry out the functions set forth in the HSTA Bylaws, Article
XIII, Section 1 h.
e.
Youth, Human and Civil Rights Committee Chairperson.
The HSTA Leeward Chapter Chairperson shall be a member of the HSTA Youth,
Human and Civil Rights Committee and represent the Chapter in such activities.
f.
Elections Committee Chairperson. The
HSTA Leeward Chapter Chairperson shall be a member of the HSTA Elections
Committee and shall carry out its functions in this Chapter.
g.
Membership Services Committee Chairperson.
The HSTA Leeward Chapter Chairperson shall be a member of the HSTA
Membership Services Committee and shall carry out its functions in this Chapter.
h.
All standing committees shall further the goals and objectives of HSTA.
i.
When a member of either the State Negotiations Committee or Elections
Committee is selected the Chairperson, that member's Chapter shall have the
option of appointing another representative to replace the member who has been
selected chairperson.

ARTICLE VI.
DELEGATES TO HSTA CONVENTION
Section 1.
Delegates to HSTA Convention.
a.
Selection
The
delegates to the HSTA Convention shall be selected for one year in accordance to
HSTA Bylaws, Article V, Sections 1-4.
b.
Duties
The
Convention delegates shall attend Representative Assembly prior to and following
the Convention, all pre-convention and Convention caucuses, and all Convention
meetings.
ARTICLE VII. NEA
CONVENTION DELEGATES
Section 1.
NEA Delegates.
The HSTA
Leeward Chapter shall elect NEA Convention Delegates from its active NEA
membership as set forth by the HSTA Bylaws.
Delegates shall be elected for one-year terms.
If the delegate is unable or unwilling to attend the NEA Convention, the
position shall be filled by an elected alternate with the approval of the HSTA
Leeward Chapter Executive Board.
Section 2.
Other Delegates.
All persons
holding offices or other positions, elective or otherwise, in the Chapter are
eligible to be delegates to the NEA Representative Assembly, providing they are
active NEA members.
ARTICLE VIII.
NOMINATIONS, ELECTIONS, SPECIAL ELECTIONS,
ELECTION
PROCEDURE
Section 1.
Nominations.
a.
Each school association shall be entitled to present name(s) for the
office of President, Vice President, Treasurer, HSTA Board of Directors.
Such names shall be in the hands of the Elections Committee on or before
the date specified by the Elections Committee.
Nominations for these offices may come from the floor of the
Representative Assembly.
b.
Nominees shall be in good standing with the HSTA Leeward Chapter, Hawaii
State Teachers Association and the National Education Association for at least
one year.

Section 2.
Elections.
Elections
may be conducted through the school association or other means as determined by
the Elections Committee during the time limits specified by the Elections
Committee. The election shall be
completed not later than May 15. The
candidate receiving the highest number of votes shall be declared elected.
Elected officers shall assume their elected offices no later than the
first day of the fiscal year as set by the Hawaii State Teachers Association.
a.
Officers, HSTA convention delegates, NEA convention delegates and faculty
